Abstract

This study aims to clarify the role of artificial intelligence (AI) in analyzing and interpreting conflicting Islamic legal evidences with precision, in order to achieve balance, find appropriate solutions, and assist in the process of weighing between them. Given that Islamic Sharia is suitable for all times and places, it is essential to establish fundamental guidelines for employing this technology to minimize errors in such a critical matter and to facilitate scientific procedures leading to sound analysis and deduction. The study discusses the potential of AI to incorporate the principles governing conflicting evidences and preference (tarjīḥ), such as prioritizing stronger evidence in terms of indication or transmission, adhering to the practices or abstentions of the Companions (may Allah be pleased with them), or aligning with the general principles and objectives (maqāṣid) of Islamic law, among other recognized criteria of preference. The study concludes that AI can indeed provide assistance in the process of weighing conflicting evidences in a timely manner, thereby guiding the jurist toward the more probable evidence. However, the final judgment remains in the hands of the human jurist, as AI serves as a supportive tool and not an independent authority in issuing legal rulings.
